G20 Police Officer Offers Pathetic Defence……

PC Simon Harwood, 45, accused of fatally injuring newspaper seller Ian Tomlinson, has offered an implausible explanation for his actions which led to the death of Mr. Tomlinson at the G20 protest 3 years ago……

Firstly, he claimed the victim was “inviting physical confrontation”.  He went on to tell the court he believed Mr. Tomlinson was being “deliberately obstructive and tactically encouraged to move him during [the] violent demonstrations”.  Mr. Tomlinson was simply trying to return home from work and any “obstruction” was to Mr. Tomlinson who was walking along a public highway, as was his right.  Harwood struck Mr. Tomlinson with a baton and then pushed him to the ground to “encourage” him to move away from Police lines.  Shortly afterwards Mr. Tomlinson died from a heart attack……

Harwood then told the court “From where I saw him from, he looked like he wasn’t going to move and was looking at Police as if he wanted them to move him away”.  Having practiced a few expressions in the mirror, I can do happiness, anger, shock and various other expressions but was not able to achieve the facial expression which would suggest I wanted to be moved away……

Harwood, tellingly, told the court “At the time I though he was obstructing it [the police line] not allowing us to achieve our objective.  I believe he was doing it on purpose”…

In my opinion, the Police objective is legally flawed.  It is a citizens right to walk along a public highway without undue impedance and the Police are at fault in their practice of “Kettling”, which entails blocking access to the publics right of way in order to surround a crowd of protesters.  The assumption that everybody within the ketlled zone is a potentially violent protester and stopped from going about their legal business is in itself a questionable legal practice……

No doubt, PC Harwood will probably be found not guilty and judged to have acted in a reasonable manner but questions need to be asked with regard to the Police’s practices when dealing with legal public protests……
